Article 1: Scope of application

The general conditions of service establish the rights and duties of Mrs Laurie Berthet, operating as an interior designer under the name of LORYCOSY HOME DESIGN, and identified by the SIRET number 92851963600015, hereinafter referred to as “We” or by its name, on the one hand, and any individual or legal entity wishing to benefit from our services, hereinafter referred to as the “Customer”, on the other;

These conditions take precedence over any other provision, unless expressly agreed in writing. The Customer acknowledges having read these conditions before signing a quotation with the mention “bon pour accord” and having the legal capacity to contract with Laurie Berthet;

Any signature of the quotation constitutes express and unreserved acceptance of these conditions;

Any citizen of the European Community and of countries complying with Directive 95/46/EC may not invoke his or her lack of understanding of the language as grounds for cancellation of the contract;

These terms and conditions define the terms and conditions for the performance of our services at the express request of the customer. They may be supplemented, where applicable, by special conditions attached hereto.

Article 2 – Nature of services :

Our services are designed to meet the need for advice, support and implementation of interior design projects. Our services include decorating coaching, project design, home staging, 3D projections and photo realism. We intervene only at the customer’s request. The date and place of performance of the services are agreed by telephone between Us and the Customer. We undertake to do our utmost to satisfy the customer in accordance with the estimate, keeping him regularly informed of the progress of our work.

Article 3 – Website and contractual commitment: 

The main purpose of theLORYCOSY HOME DESIGN website is to provide information about the interior design services offered by Laurie Berthet. We strive to provide accurate illustrations to give a realistic view of our services, however photos, images and graphic representations are merely illustrative and non-contractual.

Article 4 – Design phases :

The plans provided by Laurie Berthet, director of LORYCOSY HOME DESIGN, are for information only and have no contractual value. They are designed for aesthetic purposes only. The companies or suppliers responsible for the work must take their own measurements on site and adapt their techniques accordingly. Similarly, after any demolition operation, they are responsible for drawing up their own execution plans. They are also required to check measurements on site and to adapt technically after any demolition operation, while taking into account the customer’s preferences. In the case of the opening of carriers or partitions, the intervention of a concrete or structural engineer is required. The customer acknowledges having read and understood this information before signing the quotation with the mention “bon pour accord”. Signing the quotation implies acceptance of these conditions.

Article 5 – Prior quotation and acceptance 

For any intervention, a written estimate will be drawn up. This estimate will include the customer’s contact details, details of the services and products required, and the total cost excluding VAT. The quotation is free of charge and is valid for one month from receipt by the Customer.

The signing of the quotation by the customer in duplicate constitutes an order. Each party shall retain one copy. The quotation sets out the terms, duration and price of the service to be provided. A deposit of 40% will be requested before any project is carried out, and the balance of 60% will be claimed on receipt of the project.

Article 6 – Applicable rates 

The customer is informed of the prices of services before any intervention by means of an estimate. Rates are quoted “from” and are subject to change without notice;

Article 7 – Terms of payment 

In exchange for services rendered in accordance with the terms of the quotation attached to this contract, the customer agrees to pay Laurie Berthet, director of LORYCOSY HOME DESIGN, the amount specified in the signed and accepted quotation. Any request for additional services not included in the initial quote will give rise to a supplementary quote. An invoice will be automatically issued upon confirmation of the order and sent to the e-mail address provided by the customer. Remote orders must be paid for in full in a single instalment. For services provided at the customer’s premises, full payment is required on the day of the visit. No reservations can be made regarding payment for services.

Article 8 – Terms of payment 

Payments may be made by bank transfer, cash or cheque made payable to “Laurie Berthet – LORYCOSY HOME DESIGN”.
Laurie Berthet, director of LORYCOSY, reserves the right to suspend all order processing and deliveries in the event of non-payment by the customer. In addition, Laurie Berthet, director of LORYCOSY HOME DESIGN, reserves the right to refuse any delivery or to process any order from a customer in dispute or non-payment for a previous order. In the event of late payment, late payment penalties will automatically be applied in accordance with the law in force. These penalties will be added to a fixed indemnity for collection costs.

Article 9 – Commitment of the customer 

The customer agrees to make available to Laurie Berthet, director of LORYCOSY HOME DESIGN, all the means necessary for the realization of the services, including access to the places and objects concerned, as well as the taking of photographs for the study of the project. The customer also agrees to make the modifications required to guarantee the proper execution of the services, as requested by Laurie Berthet, director of LORYCOSY HOME DESIGN.

Article 10 – Modification and cancellation 

To change or cancel an appointment, please give us at least 48 hours’ notice. Both parties must then agree on a new date. If the customer cancels the service in progress, the deposit paid will be considered as damages. In accordance with the law, the customer has a 14-day withdrawal period from the date of signing the quotation. This retraction must be notified by registered letter with acknowledgement of receipt to the address indicated in the quotation. Reimbursement will be made within fourteen days of receipt of the letter. This provision only applies to consumers.

However, the right of withdrawal does not apply to service contracts that have been fully executed before the end of the withdrawal period, and whose execution has begun with the customer’s prior agreement. In the event of withdrawal outside this period, the customer forfeits the amount of the quotation and any deposits paid.

In the event of termination by Laurie Berthet, Managing Director of LORYCOSY HOME DESIGN, only work completed up to the date of termination will be invoiced. If the invoiced amount exceeds the advance payments made by the Customer, the latter must pay the difference within ten days of receipt of the invoice. Should this not be the case, Laurie Berthet, director of LORYCOSY HOME DESIGN, undertakes to reimburse the Customer for the excess amount.

Article 11 – Performance of services 

Laurie Berthet, manager of LORYCOSY HOME DESIGN, undertakes to carry out the tasks defined in the quotation, in accordance with the standards of quality and expertise. She also undertakes to provide documents relating to the execution of the services.

Article 11 – Delivery 

In the event of recommendations of materials or purchase of furniture from third parties, Laurie Berthet, director of LORYCOSY HOME DESIGN, declines all responsibility for any delays in delivery. For project follow-up, a schedule will be agreed with the customer, including scheduled acceptance dates with external suppliers. Laurie Berthet, director of LORYCOSY HOME DESIGN, cannot be held responsible for any delays on the part of external suppliers.

Article 12 – Intellectual Property and Confidentiality 

Plans, sketches, drawings, sketches, 3D projections, photos and any other document or work resulting from the mission of Laurie Berthet, interior decorator at LORYCOSY HOME DESIGN, remain her property at all stages of the mission and are protected by the provisions of the French Intellectual Property Code. Laurie Berthet retains the right to decide whether or not to transmit her source files to the companies in charge of the work. Laurie Berthet cannot be held responsible for any modification of the source files by the companies in charge of the work. Laurie Berthet has the right to publish plans and photographs before and after the completion of her work. If the companies in charge of the work wish to publish or edit them, they must obtain Laurie Berthet’s prior agreement and, in all cases, these publications must be accompanied by the words “design and creation by Laurie Berthet, interior decorator at LORYCOSY HOME DESIGN”.

The general structure and content of the LORYCOSY HOME DESIGN website are protected by copyright. The customer agrees not to compete directly or indirectly with the activity of Laurie Berthet, director of LORYCOSY HOME DESIGN. Links to the site https://www.lorycosy-homedesign.fr/ are subject to prior authorization. Users are not authorized to use the ” framing ” or ” leeching ” technique without authorization. In accordance with the French Data Protection Act, the customer’s personal data is required to process the order and may be communicated to the contractual partners of Laurie Berthet, director of LORYCOSY HOME DESIGN. Customers have the right to access, modify and rectify their personal data.

Article 13 – Liability 

Laurie Berthet, director of LORYCOSY HOME DESIGN, assumes only an obligation of means and cannot be held responsible for indirect damage. Laurie Berthet is not responsible for information transmitted by the customer, nor for the implementation of decorating and furnishing recommendations. Laurie Berthet, director of LORYCOSY HOME DESIGN, does not guarantee that the colors displayed on the site correspond exactly to the actual products.

Article 14 – Referencing 

The customer acknowledges and accepts that Laurie Berthet, director of LORYCOSY HOME DESIGN, may take photographs of the premises before the start of the work and after its completion. These photos will be used for professional purposes, such as promoting our services on our website, our social networks and any communication media related to our business. Under no circumstances will they be used for commercial purposes without the customer’s prior consent. Laurie Berthet, director of LORYCOSY HOME DESIGN, undertakes not to divulge the customer’s name or any other personally identifiable information without the customer’s explicit authorization. The customer understands that these photographs are essential to illustrate his work and share the evolution of the transformed spaces. By signing the general terms and conditions of sale, the client consents to the taking of photographs of the premises before the work begins and after its completion.

Article 15 – Insurance: 

Laurie Berthet, director of LORYCOSY HOME DESIGN, has taken out civil and professional liability insurance. This insurance policy is available on request. The customer is responsible for ensuring that the service providers chosen to carry out the work are insured for their professional activity.

Article 16 – Force majeure

In the event of force majeure, the performance of contractual obligations is suspended. Laurie Berthet, director of LORYCOSY HOME DESIGN, will inform the customer within 24 hours of the occurrence of the event. If the situation persists for more than 30 days, the contract may be terminated without compensation.

Article 17 – Autonomy of clauses

The nullity or inapplicability of any of the clauses shall not invalidate the other stipulations, which shall retain their force and scope.

Article 18 – Applicable law and disputes

These terms and conditions are governed by French law. In the event of a dispute between the customer and the service provider, the parties will first attempt to resolve their differences by amicable agreement, setting a deadline for this resolution.

If the dispute persists between the two parties, the competent court will be that of the service provider’s head office.
